Supreme Court Limits Authority of Federal Agencies

On June 28, 2024, the United States Supreme Court overturned the Chevron Deference Doctrine, a precedent from 1984, which allowed federal agencies to interpret ambiguous laws. This ruling means that Congress will need to be more specific when drafting and passing legislative language, and courts will interpret ambiguity in laws without deferring to federal agencies.

It is important to note that most of the recreational community’s UAS requirements are specifically mandated by Congress in U.S.C. 44809. There could, however, be ambiguous areas of the law where the FAA has provided its own interpretation. AMA is reviewing the current law and rules regarding recreational UAS to see if this ruling will have an impact on our current requirements.
