Synopsis:

A3157 – Establishes the requirement for LE conducting a surveillance operation to obtain a court order. Also, establishes the requirement that any LE agency that purchases a drone is also required to provide public notice of the purchase in a newspaper. Any person who purchases, owns, or possesses an unmanned aerial system capable of monitoring, observing, photographing, listening to, or making a recording of a person(s) is guilty of a disorderly persons offense.

Definition of ‘unmanned aerial system’ would include MA.

A3929 – Provides that no State, local, or interstate law enforcement agency or officer shall utilize an unmanned aerial vehicle to conduct surveillance or to gather any evidence or engage in any other law enforcement activity. Exceptions provided to counter a high risk of a terrorist attack or when ordered by the Governor during any declared disaster or emergency.
