The move comes in the wake of a number of<\/span><a style=\"color: #c61a1a;\" href=\"https:\/\/mashable.com\/2014\/10\/26\/drone-beat-stadium-space-drone\/\">reports<\/a><span style=\"color: #222222;\">\u00a0<\/span><a style=\"color: #c61a1a;\" href=\"https:\/\/www.bbc.com\/news\/uk-england-29689360\">worldwide<\/a><span style=\"color: #222222;\">, including\u00a0<\/span><a style=\"color: #c61a1a;\" href=\"https:\/\/kxan.com\/2014\/09\/03\/ut-police-say-second-drone-was-in-use-near-stadium\/\">within the United States<\/a><span style=\"color: #222222;\">, of \u201cdrone\u201d use at sporting events. Though these incidents certainly raise legitimate safety concerns, the FAA\u2019s response is problematic for a number of reasons. It exploits fear and post\u20139\/11 anti-terrorism statutes to enact a solution that is of dubious legality and efficacy that could negatively impact law abiding citizens who pose no real threat to stadiums. More importantly, it is emblematic of a\u00a0<\/span><a style=\"color: #c61a1a;\" href=\"https:\/\/techliberation.com\/ongoing-series\/ongoing-series-moral-panics-techno-panics\/\">technopanic<\/a><span style=\"color: #222222;\">-driven approach to civilian drone policy that has only become more irrational and draconian in the last month.<\/span><\/p>\n<h3 style=\"color: #222222;\">What the FAA has Banned<\/h3>\n<p style=\"color: #222222;\">Let\u2019s begin by taking a look at the details of the new NOTAM. It bans the use of parachutes and aircraft, including \u201cunmanned aircraft and remote controlled aircraft,\u201d up to 3,000 feet above the ground and within three nautical miles<a id=\"fnref-1\" class=\"footnote\" style=\"color: #c61a1a;\" title=\"see footnote\" href=\"https:\/\/ctovision.com\/2014\/12\/drone-fear-faa-ban-model-aircraft-near-stadiums\/#fn-1\">[1]<\/a>\u00a0of a stadium capable of holding 30,000 or more people. The ban goes into effect one hour before the beginning of the event and continues until one hour after the event. These include Major League Baseball, National Football League, NCAA Division 1, NASCAR, Indy Cup, or Champ Series events. \u201cKnowingly or willfully\u201d violating the NOTAM\u00a0<a style=\"color: #c61a1a;\" href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/49\/46307\">could result<\/a>\u00a0in a fine, up to one year in prison, or both.<\/p>\n<p style=\"color: #222222;\">But what counts as an an unmanned\/remote controlled aircraft? Based on other FAA documents, specifically its 2007 policy statement purporting to ban commercial use of drones, these include toys of a kind that are becoming increasingly popular among consumers.
